Terms of Service

1. Agreement to Terms

By purchasing the Kahani Player hardware, using the Hey Kahani mobile application (the "App"), or purchasing "Koel" story cards, you ("User" or "Parent") agree to be bound by these Terms of Service. If you do not agree to these terms, do not access our Services or use our products.

2. Eligibility & Parental Responsibility

  • Capacity: You must be at least 18 years old to create an account and register a device.
  • Supervision: The Kahani Player and Koel cards are intended for children, but the App is a tool for parents. You are responsible for the supervision of the hardware and the management of the account.
  • Account Security: You are responsible for safeguarding your login credentials. Hey Kahani, Inc. is not liable for unauthorized access resulting from your failure to protect your account.

3. Hardware Sales & Limited Warranty

  • Product Representation: We strive for accuracy in our product renders; however, slight variations in color (including our signature hex codes) and finish may occur in production.
  • Limited Warranty: Hey Kahani, Inc. warrants that the Kahani Player hardware will be free from defects in materials and workmanship for one (1) year from the date of delivery.
  • Exclusions: This warranty does not cover damage caused by accident, liquid immersion, unauthorized repairs, or "jailbreaking" the hardware firmware.
  • Shipping: Delivery dates (e.g., March 2026) are estimates. We are not liable for carrier delays but will communicate any significant production shifts.

4. Software & Content License

  • License: We grant you a limited, non-exclusive, non-transferable license to use the App and play audio content via the Kahani Player for personal, non-commercial use.
  • NFC "Koel" Tags: The purchase of a physical Koel tag grants you the right to access and play the associated audio story on a registered Kahani Player.
  • Prohibition on Circumvention: You agree not to attempt to duplicate, reverse-engineer, or "spoof" the NFC Koel tags to access content without purchase. Any attempt to modify the hardware or App to access unlicensed content will result in immediate account termination.

5. Intellectual Property

  • Ownership: All audio stories, scripts, character designs, "Conversation Card" prompts, and hardware aesthetics are the exclusive intellectual property of Hey Kahani, Inc.
  • Restrictions: You may not record, distribute, or broadcast our audio content or create derivative works based on our storytelling series without express written consent.

6. App Usage & Connectivity

  • Bluetooth (BLE): You acknowledge that Bluetooth functionality is used solely for the technical provisioning of Wi-Fi details to the hardware.
  • Availability: While we aim for 100% uptime for our cloud services (Supabase/AWS), we are not liable for temporary service interruptions.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEY KAHANI, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. In no event shall our total liability for any claim arising from the use of our hardware or software exceed the total

amount paid by you to Hey Kahani, Inc. for the specific product in question.

8. Dispute Resolution & Governing Law

  • Governing Law: These Terms are governed by the laws of the State of Delaware.
  • Binding Arbitration: You agree that any dispute or claim relating to your use of Hey Kahani products shall be resolved by binding arbitration in New York, NY, rather than in court. You waive your right to participate in a class-action lawsuit.

9. Account Deletion & Termination

  • User Termination: You may delete your account at any time using the in-app deletion tool. This will scrub your personal data within 30 days.
  • Company Termination: We reserve the right to terminate accounts that violate our IP policies or engage in fraudulent purchase activity.
